The Government of Canada has announced updates to the Open Work Permit (OWP) eligibility for family members of international students and foreign workers, effective January 21, 2025. These changes are part of the broader measures introduced in September 2024 to enhance the integrity of Canada’s temporary resident programs while supporting economic goals and addressing labor market needs.
Key Changes to Family Open Work Permits
- Eligibility for Spouses of International Students
Spouses of international students will only qualify for a family OWP if the student is enrolled in one of the following programs:- Master’s Programs: Programs lasting 16 months or longer.
- Doctoral Programs: Advanced research-based programs.
- Select Professional and Eligible Programs: Specific programs that align with Canadian priorities. Visit the links for complete list of professionaldegree and eligible programs.
- Eligibility for Spouses of Foreign Workers
Spouses of foreign workers will qualify for a family OWP if the worker:- Is employed in TEER 0 or TEER 1 occupations(high-skilled roles).
- Works in select TEER 2 or TEER 3 occupationslinked to sectors with labour shortages or government priorities, such as:
- Natural and applied sciences
- Construction
- Health care
- Natural resources
- Education, sports, and military sectors
- Has at least 16 months remaining on their work permitat the time of the spouse’s application.
- Dependent Children
Dependent children of foreign workers will no longer be eligible for family OWPs. However, they may explore other work permit options under Canada’s programs.
Validity and Renewals
- Existing OWPs: OWPs issued under the previous measures will remain valid until their expiry date.
- Renewals: In-Canada family members, including spouses and dependent children, can apply for a renewal if:
- The renewal application meets the same criteria as the current work permit.
- The renewal matches the duration of the principal applicant’s study or work permit.
Exemptions and Alternatives
- Unchanged Eligibility: Spouses of workers covered by free-trade agreements and those transitioning to permanent residency will not be affected by these changes.
- Alternative Options: Family members who no longer qualify for an OWP may still apply for other work permitsthey are eligible for under Canada’s immigration programs.
